Hello everyone! I am writing on behalf of my friend, who I had hired to take over my position when I moved from OH to VA last year. She is the office manager at a trailer dealership. They recently went from almost twenty employees to just five due to a layoff. She just found out she is pregnant and contacted HR to ask about the maternity leave options with the company. The corporate office is located in Oklahoma, and from my experience, the knowledge that the people in that office hold isn't always accurate or they are lacking. They informed her that she doesn't get any type of paid leave because there are only five people at the Ohio location. It has always been my understanding that your company has to offer you a short term disability leave, I thought it was even part of the law in some way. Does anyone have any insight on this? Does it matter if the corporate office is located in a different state? Any help would be greatly appreciated!! Thank you in advance!!!

Maternity Leave would be covered under the Family Medical Leave Act of 1993. An employee is entitled to 12 weeks of FMLA leave provided that employee has been employed by their company for 12 months, working a total of 1,250 hours.

The law that you are referring to is the Family Medical Leave Act. You can read about the specifics at the following link: http://www.dol.gov/esa/whd/fmla/ What your friend needs to determine is whether or not her company is a "covered employer" and whether or not she is an "eligible employee." Do you know whether or not her company/corporation has 50 or more employees? They do not all have to be in one location. For further clarification of the law and assistance in determining whether or not her company is obligated to comply with the law, your friend can contact the U.S. Department of Labor at 1-866-4-USA-DOL.
